Overstaying in Thailand
According to Ministry of Interior’s Order 1/2558 Regarding Classes of Aliens Ineligible for Admission to the Kingdom of Thailand. The minimum charge is 500 Baht per day. This goes to a maximum of 20,000 Baht for overstays of 40 days or longer. The good news is that if your overstay is under 90 days and you pay the fine then leave the country then you won’t have any problem returning to Thailand at a future date. May 20, 2018
UPDATE Worth a mention. It should be pointed out that “turning yourself in” means showing up at the immigration office, the airport or the border to pay the overstay fine. I would suggest anyone on an overstay of under 90 days to just pay the fine as you go to stamp out of the country.
I say this because IF you go to the immigration office to pay the fine you need to leave the country THAT day. OR you need to buy an extension denied 7 days to get out of Thailand stamp for 1900baht.
Notice also the banning for “getting caught out” inside Thailand. It states that an overstay of less than a year gets you a 5-year ban. <- That means IF you’re caught out on something else inside the country and they see you are on ANY overstay (even one day) you could be run thru the system and banned for 5 years.
My advice is DON’T OVERSTAY. It is not a joke, it is not to be taken lightly.
When entering the Kingdom of Thailand, please be mindful of the last day on your stay permit and DO NOT stay longer than the permitted date.
If you overstay for up to 90 days, you must pay a fine of 500 Baht per day, but not exceeding 20,000 Baht, before you are allowed to leave the Kingdom of Thailand.
Since March 2016, anyone with a lengthy overstay, over 90 days, will be banned from re-entering the Kingdom of Thailand as shown in the details below. Note that all non-Thais are referred to as Aliens by Thai Immigration. You receive less of a ban if you surrender to the authorities and aren’t arrested and prosecuted.
Alien Surrendered to Authorities:
An alien who overstays more than 90 days beyond his/her permitted date will be banned from re-entering the country for 1 year, starting from the departure date.
An alien who overstays more than 1 year beyond his/her permitted date will be banned from re-entering the country for 3 years, starting from the departure date.
An alien who overstays more than 3 years beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
An alien who overstays more than 5 years beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
Alien Being Arrested and Prosecuted:
An alien who is caught overstaying less than 1 year beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
An alien who is caught overstaying more than 1 year beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
